When legal entanglements became a Gordian knot, Frederik Kjaergaard-Higgins got out his scissors. Because of litigation arising out of losses at one site, a client’s legal team did not allow the insurance team to release any critical engineering information to insurers, according to the risk manager. That led many of the more than a dozen insurers to implement London Engineering Group Endorsement 1 (LEG1) defective restrictions.
“The goal for renewal was to shift to [less restrictive] LEG2 where possible, manage cost, and improve terms and conditions,” said the risk manager. “Through the perseverance of Fred and his team, as well as our insurance team, we were able to release critical information to insurers with respect to the losses. The result was 118% capacity offered, all insurers agreeing to LEG2, and a reduction in the deductible from a key insurer.
Four new insurers were also brought onto the program. The overall premium remained just under flat, and the program rate movement was a 6.53% rate decrease.” The president at another client explained that “because of our project finance structure … Fred had to engage in placing two programs to meet the needs of our lenders and shareholders. That, on top of valuation adjustments and an agreement to sell one major asset during the renewal process, made the engagement extremely challenging. Fred persevered and led us to an on-time renewal at attractive rates … and avoided any last minute drama.”
