A former attorney, Jerald Khoo practices a multipronged approach to customer service. An example of how he puts his philosophy into action is the time when one client was a potential buyer in a transaction where the counterparty sellers were unable to provide indemnification over potential limited partner clawbacks.
Khoo worked with the client, the seller, and an insurance underwriter to explore a first-of-its-kind solution to address underlying concerns. He led negotiations with the insurance underwriter, pushing them towards agreeing to policy coverage that was broad enough to suit the needs of the deal parties, and advised the client on potential triggers that would result in a claim payout. Upon seeing that a potential insurance solution was available, the deal parties started to progress their negotiations on the underlying transaction and quickly finalized deal documentation.
In another recent case, a client was looking to buy a company and was having difficulty coming to terms with the seller on reps and warranties and the liability to be assumed by the buyer. Khoo helped advise the client on a fast turnaround — the deal was done with an innovative and creative solution. The client said everyone, from senior members of the firm to the firm’s investment committee, was quite happy with Khoo’s work. Added the client: “He is definitely deserving of this award.”
