2024 Theo Award Winner: INS Insurance Inc.

INS Insurance Inc., a captive insurer of Schneider National, faced an uphill climb in managing workers’ compensation claims for an aging nationwide workforce amid pandemic-related supply chain disruptions. The company also grappled with leveraging new truck technology, changes in federal policy and economic conditions, and shifting landscapes in workers’ compensation jurisprudence and medical costs.

INS Insurance implemented a comprehensive strategy to improve performance, communication, and outcomes within its claims department. The program’s success led to INS Insurance winning the 2022 Schneider Presidential Award for Operational Excellence for “changing the way the workers’ compensation industry views claims handling, broadening the mindset to provide holistic support to Schneider’s injured workers.”

Tackling the Problem

INS Insurance fostered close collaboration between attorneys, Sedgwick adjusters and INS adjusters. Upon assignment of claim files, attorneys prepare early case assessments, followed by a 30-minute team call to review action plans and address questions. This approach ensures efficient relay and understanding of relevant information for effective decision making.

“In late 2020, we created the National Coordinating Counsel program for our workers’ compensation area, similar to a program we had in our auto space,” said Sandi Adkins, the organization’s senior claims manager. “We believed there were real benefits and applicability in the workers’ compensation space.

After interviewing three incredibly talented attorneys, we decided to take all three based on their demonstrated talent. The program consists of one national counsel who oversees the entire program, including approximately 72 local panel counsel across the nation. Additionally, there are two regional coordinating counsel: one handling the Southeast and California, and the other handling the Mountain Plains, Northwest, Midwest and Northeast.”

A solid framework and guidelines underpin the entire program, Adkins explained. “When setting up this program, we established four key pillars: consistency, cost savings, education, and advocacy. This year, we added a fifth pillar focusing on diversity and inclusion, encouraging it throughout everything we do.”

Adkins’ team conducts annual performance reviews with detailed feedback for all counsel who have worked on at least one case in the prior year.

“Using our smart sheets, we track and measure their performance on various metrics, including timeliness of early case assessments, days from assignment to settlement, payout ratio, initial evaluation accuracy, budget accuracy, legal spend as a percent of overall file spend, and qualitative factors such as communication, billing within guidelines, performance at round tables and claims reviews, and education and advocacy efforts.

“Our current approach focuses on partnership,” she said. “We provide them with a comprehensive report card, offering feedback and coaching throughout the year.”

INS also began holding formal CLEs via webinar for its attorneys in 2021. These webinars cover various industry-relevant topics, such as the use of truck technology and biomechanical experts in workers’ compensation, accuracy in medical ratings, and disputing ratings that are not up to date or properly conducted. 
 
“We also organize lunch-and-learn sessions for our team, providing quick reminders and bringing them back to the program. Furthermore, we give out partnership awards and host a litigation summit every two to three years in person to foster collaboration and recognize outstanding performance.

Another focused shift for the organization was an active embrace on the biopsychosocial approach to injury recovery and return to work.

“In 2021, my team and I began to explore the benefits of focusing on the psychological and social impacts of workers’ compensation claims, as much as we were already focused on medical recovery,” said Adkins. “We completely flipped our philosophy, from a purely biomedical approach to a biopsychosocial approach, starting from the initial phone call.

“We inquire about their support system at home, reliable transportation to appointments, and their fears and concerns. By having a conversation focused on their path to healing, proactively identifying barriers, and addressing them upfront using available resources.”

As a result, she said, employees are more invested in their recovery, they get back to work faster, and ultimately, it costs less for the organization.

“The results exceeded our expectations, with $9 million in savings per year and people returning to work 50 to 60 days faster on average,” she said. “As a safety-first organization with high requirements for pushing and pulling, our drivers, who make up the majority of our injuries, need to be completely healthy to return to work.”

Success to Build On

This foundational shift in approach has yielded significant results, demonstrating the program’s effectiveness in supporting injured workers’ recovery and reintegration into the workforce.

Within four years of implementation, the program achieved substantial cost savings for the company. But the real proof is in significantly improved outcomes for injured workers, underscoring the effectiveness of the worker-centric approach to care.
