Entertainment industry insurance is never what it seems.
“In motion pictures and television, we face production scenarios that require underwriter approval or unique negotiations more often than other industries or even other parts of our business. It happens a lot,” said Matt Ruffner, director of risk management, The Walt Disney Company.
In one instance that occurred this past year, Ruffner experienced what he referred to as a “unique situation” involving prop vehicles at a Canadian set location. In particular, the Insurance Corporation of British Columbia makes the process of transferring automobile risk a complicated one.
“The law in some international jurisdictions requires the owner of the vehicle to carry the primary insurance regardless of who is operating it, yet the vehicle is being rented to customers, [us,] who they have no control over. The owners don’t want to be responsible for a customer’s accident,” Ruffner said.
Ruffner tapped his broker Faye Yu to help with negotiations in placing the auto coverage; it was a lengthy discussion.
“[Faye] was able to get [our underwriter] to insure our contractual indemnity obligations back to the owners for these accidents under our general liability policy,” Ruffner said. “It gives us peace of mind that there is insurance in place for these vehicles, where a commercial product doesn’t otherwise exist.”
