Peg Niekrasz’s complex claims skills were put to the test when she had to intervene to resolve a coverage dispute between her client — a global agrochemical company — and two carriers for two different policy periods.

The day before the policy term date, the client received notice that the apples it had sprayed a few months earlier to delay the ripening process were showing signs of low pressure and ripening too early.

Its initial policy had a $25,000 deductible, while the subsequent policy with a different insurer had a $250,000 deductible, and both carriers were notified of the claim. However, both disputed when the loss had occurred, with each saying it had happened during the other’s policy period.

The first insurer said it was willing to contribute 50% toward a $550,000 settlement. But since the other insurer’s policy had a $250,000 deductible, that meant Niekrasz’s client would have to fund a significant part of the settlement itself.

However, Niekrasz argued that the second insurer was liable for the claim because the loss occurred during the prior policy term. She was able to successfully convince the insurer to pay the whole settlement, less the $25,000 deductible, saving her client $250,000.
